1. Acceptance of these terms

By downloading, installing, or using SSHWave (the "App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App. The App is distributed through the Apple App Store; Apple's Licensed Application End User License Agreement ("EULA") also applies, and where these Terms conflict with that EULA, the EULA controls for matters between you and Apple.

2. The App is free

SSHWave is provided to you free of charge. There are no in-app purchases, subscriptions, or paid features. We make no commitment that the App will remain available indefinitely or in its current form, but we will not start charging existing users for features that were previously free.

3. License to use the App

We grant you a personal, worldwide, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices that you own or control, in accordance with the Apple App Store rules. This license does not transfer ownership of the App or its code to you.

4. Acceptable use

SSHWave is a tool for connecting to computer systems you are authorized to access. You agree not to use the App:

  • to access any system without explicit authorization from its owner;
  • in violation of any applicable law, including computer-misuse, export-control, or anti-fraud laws;
  • to harm, harass, defraud, or impersonate any person or entity.

You are solely responsible for the actions you take through SSHWave and for the consequences of those actions on the remote systems you connect to.

5. Your data

SSHWave stores your hosts, keys, passwords, and known-host fingerprints on your device, as described in the Privacy Policy. We do not have access to that data; we cannot recover it for you if you lose your device or delete the App. Back up your keys before relying on them in production.

6. Third-party services and software

SSHWave connects you to third-party servers that you choose. We do not operate those servers, do not endorse them, and are not responsible for their content, security, availability, or terms. The App incorporates open-source software, including the Citadel SSH library, used under its respective license.

7. Warranty disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DATA YOU STORE OR TRANSMIT THROUGH THE APP WILL NOT BE LOST OR ALTERED.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE AUTHORS, COPYRIGHT HOLDERS, OR DISTRIBUTORS OF SSHWAVE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES (INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability for incidental or consequential damages, so the above limitations may not apply to you in full.

9. Indemnification

You agree to indemnify and hold harmless the authors and contributors of SSHWave from any claim or demand, including reasonable attorneys' fees, arising out of your use of the App or your breach of these Terms.

10. Export controls

SSHWave uses standard cryptography (AES, ChaCha20, Curve25519, RSA, ECDSA) via the SSH protocol. You agree to comply with all applicable U.S. and international export and re-export laws and regulations, including the U.S. Export Administration Regulations and the sanctions programs administered by the U.S. Treasury Department's Office of Foreign Assets Control.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you within the App. Your continued use of the App after the changes take effect constitutes acceptance of the updated Terms.

12. Termination

You may stop using the App at any time by deleting it from your device. We may also discontinue the App at any time. The disclaimers and limitations above survive termination.

13. Governing law and venue

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the App will be brought exclusively in the state or federal courts located in San Francisco County, California, and you consent to the personal jurisdiction of those courts.

14. Apple-specific terms

You acknowledge that these Terms are between you and the developer of SSHWave only, not with Apple, and Apple is not responsible for the App or its content. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you. Apple has no other warranty obligation whatsoever with respect to the App. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance of these Terms, will have the right to enforce these Terms against you as a third-party beneficiary.
